Statement of the Connecticut and Suburban New York Chapter In Opposition to Section 1 of Raised Bill 5436
Statement of the Connecticut and Suburban New York Chapter in Support of Raised Bill 120
Dear NAIOP Chapter Members: Our teaming with the Connecticut Business and Industry Association appears to have succeeded in obtaining the approval of the Environmental Committee of the Connecticut General Assembly of RB 120, a bill that, if and when enacted, will constitute a major first step in achieving regulatory reform in Connecticut. The bill will compel the Connecticut Department of Environmental Protection to use the due process procedures required by law under the state's Uniform Administrative Procedures Act when it issues dictates that have broad effect. The UAPA contains requirements for "notice and comment" rulemaking and review/approval by the legislature before regulations can take effect. DEP's current use of "Guidance" documents gives it unilateral power to impose onerous obligations on entities subject to its regulatory programs, including stormwater regulation, Transfer Act cleanup of contaminated properties, and other programs that members of the commercial real estate community must deal with. We must now maintain both our vigilance and pressure to assure that the bill reaches the floor of the General Assembly for a vote.
